1. Scope and Coverage

This Privacy Policy ("Policy") describes how Kushite Capital Corporation, a Wyoming corporation, doing business as Industry Advisors ("Industry Advisors," "Company," "we," "us," or "our"), collects, uses, discloses, and safeguards information when you visit, register with, or use any of our websites, portals, subdomains, mobile applications, and communications (collectively, the "Services").

By accessing or using the Services, you agree to the collection, use, and disclosure of information in accordance with this Policy. If you do not agree, please do not use the Services.

2. Information We Collect

We collect information you provide directly, information collected automatically as you use the Services, and information from third parties.

Information You Provide. This includes:

  • Identifiers such as name, email address, mailing address, and telephone number.
  • Account credentials (username, hashed passwords, security questions).
  • Business information (entity name, EIN, state of formation, industry, ownership structure, roles).
  • Payment information (billing address, card details processed by our payment processors).
  • Uploaded documents and file attachments submitted to the client portal, formation intake forms, or bookkeeping utilities.
  • Communications and correspondence (support requests, chat transcripts, email replies, voicemails).
  • Survey responses, quiz submissions, and feedback.

Information Collected Automatically. When you use the Services we may collect:

  • Device and browser information (IP address, browser type, operating system, device identifiers).
  • Usage data (pages visited, time on page, referral source, click paths, session duration).
  • Cookies, pixels, local storage, and similar technologies.
  • Geolocation derived from IP address (approximate; not precise GPS).

Information from Third Parties. We may receive information from payment processors, identity verification vendors, marketing partners, analytics providers, and public records (only when relevant to your use of formation, tax, or bookkeeping services).

3. How We Use Your Information

We use the information we collect to:

  • Deliver, operate, and maintain the Services.
  • Process transactions, fulfill orders for digital products and Action Kits, and manage subscriptions.
  • Provide administrative business, tax resource, and educational support.
  • Communicate with you regarding your account, purchases, requests, and product updates.
  • Send marketing communications, newsletters, and educational content (subject to your consent where required by law and always with an opt-out).
  • Personalize content, remember preferences, and improve user experience.
  • Detect, investigate, and prevent fraud, abuse, and security incidents.
  • Comply with legal obligations, court orders, and regulatory requirements.
  • Enforce our Terms of Service and other agreements.

We never sell your personal information.

5. Shopify and Third-Party Service Providers

Our storefront and checkout are operated on the Shopify platform. When you place an order, create an account, or submit information through checkout, Shopify processes that data on our behalf as a data processor. Shopify's own privacy practices are described in Shopify's Privacy Policy (https://www.shopify.com/legal/privacy), which we encourage you to review. Payment card information you enter at checkout is transmitted directly to Shopify Payments, Stripe, PayPal, or another payment processor selected by you and is not stored on our servers.

We also work with the following categories of third-party service providers:

  • Payment processors (Shopify Payments, Stripe, PayPal, and similar).
  • Email service providers (transactional and marketing email delivery).
  • Hosting, infrastructure, and content delivery networks.
  • Customer support and helpdesk platforms.
  • Analytics and product-usage tools (Google Analytics, Shopify Analytics, Meta Pixel where applicable).
  • Identity verification and fraud prevention vendors.
  • Cloud storage providers used by the client portal (portal.industryadv.com).
  • Bookkeeping and accounting integrations you elect to connect (e.g., QuickBooks Online).

Each of these providers is subject to contractual confidentiality obligations and is permitted to use your information only to perform services on our behalf.

6. Disclosure of Information

We may share information:

  • With service providers as described above.
  • With integrations you connect at your direction (e.g., QuickBooks, Google Drive, banking data providers).
  • To comply with laws, subpoenas, court orders, or lawful government requests.
  • To enforce our Terms of Service or other agreements, or to protect the rights, property, or safety of Industry Advisors, our users, or others.
  • In connection with a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, in which case information may be transferred as a business asset.
  • With your consent or at your direction.

We do not sell, rent, or trade personal information to third parties for their own marketing purposes.

7. Data Security

We use administrative, technical, and physical safeguards designed to protect information from unauthorized access, disclosure, alteration, and destruction. Stored information is protected via encryption in transit (TLS) and at rest, and by limited-access servers located in North America. Payment data is handled by PCI-DSS-compliant processors.

No method of transmission over the internet or storage system is completely secure, and we cannot guarantee absolute security. You are responsible for maintaining the confidentiality of your account credentials and for any activity that occurs under your account.

8. Data Retention

We retain personal information for as long as necessary to provide the Services, comply with legal obligations, resolve disputes, and enforce our agreements. Retention periods vary by data type; for example:

  • Account records: for the life of the account plus a reasonable period thereafter.
  • Transaction records: as required by tax, accounting, and consumer-protection laws (generally at least seven years).
  • Marketing preferences and opt-outs: retained until you request deletion.
  • Support tickets: typically 24 months.

When information is no longer needed, we securely delete or anonymize it.

9. Your Rights and Choices

Depending on where you live, you may have the following rights with respect to your personal information:

  • Access — request a copy of the information we hold about you.
  • Correction — request that we correct inaccurate or incomplete information.
  • Deletion — request that we delete personal information, subject to legal retention obligations.
  • Portability — request a copy of certain information in a portable format.
  • Opt-Out of Marketing — unsubscribe from marketing emails using the link in any message.
  • Cookie Choices — manage non-essential cookies through browser settings or the site cookie banner.
  • Do Not Track — we do not currently respond to browser Do-Not-Track signals.

California, Colorado, Connecticut, Virginia, and Similar State Residents. You may have additional rights under state privacy laws (CCPA/CPRA, CPA, CTDPA, VCDPA, and similar), including the right to know the categories of personal information collected, the right to opt out of sale/sharing (we do not sell), and the right to non-discrimination for exercising your rights. 10. International Users

The Services are operated from the United States. If you access the Services from outside the United States or Canada, you consent to the transfer of your information to, and processing in, the United States and Canada under U.S. and Canadian law, which may differ from the laws of your home jurisdiction.

11. Children's Privacy

The Services are directed to adults aged 18 and older. We do not knowingly collect personal information from anyone under 18. If you believe a minor has provided us with personal information, contact us at support@industryadv.com and we will delete it promptly.

12. Third-Party Links and Integrations

The Services may link to third-party websites, tools, or services that are not owned or controlled by Industry Advisors. This Policy does not apply to those third parties, and we are not responsible for their content or privacy practices. We encourage you to review their privacy notices before providing information.

13. Dispute Resolution

Privacy-related disputes are subject to the binding arbitration, class-action waiver, and governing-law provisions in the Industry Advisors Terms of Service, which are incorporated here by reference.

14. Changes to This Policy

We may update this Policy from time to time to reflect changes in our practices, technologies, legal requirements, or other factors. Updates will be posted at www.industryadv.com/pages/privacy-policy and, when material, will be communicated via email or a prominent notice on the Services. The "Last Updated" date at the top of this Policy indicates when it was last revised.
